(ORAL) This petition under Section 482 Cr.P.C., has been filed by the petitioner for quashing FIR No. 528 dated 05.08.2018 (Annexure P-1) registered under Section 18 of the NDPS Act and all the subsequent proceedings qua the petitioner, as the main accused, namely, Man Bahadur, has already been acquitted by the trial Court vide judgment dated 29.05.2019.

Pursuant to the order dated 17.03.2021, status report dated 16.04.2021 filed by way of affidavit Sh. O.P. Singh, Commissioner of Police, Faridabad, is taken on record.

As per aforesaid status report, after completion of investigation challan was present before the trial Court against the petitioner and his co-accused-Tarun Sharma, on 30.10.2020. Charges have been framed by the trial Court against them and the trial is in RISHU KATARIA 2022.09.23 10:15 I attest to the accuracy and authenticity of this document

In view of the above, learned counsel for the petitioner submits that he may be permitted to withdraw the instant petition, with liberty to raise all the pleas taken herein, before the trial Court, at an appropriate stage.
