R.P. Nagrath, J. (Oral) Instant petition has been filed under Section 482 Cr.P.C. seeking direction to respondents no. 1 to 2 to protect life and liberty of the petitioner and also to register FIR against respondents no. 3 and 4 for committing house trespass and causing loss to the property of petitioner and for threatening to kill him. It is further prayed that respondent no. 2 may be directed to take departmental action against respondent no. 5 for illegally helping respondents no. 3 and 4.
As per office report, respondent no. 5 could not be served due to non filing of his correct address. Learned State counsel on instructions from HC Amarjit Singh submits that respondent no. 5 is presently posted in District Amritsar. Therefore, service of respondent no. 5 is dispensed with. CRM-M-15332 of 2014 -2respondents no. 1 and 2 should be directed to ensure safety of life and liberty of the petitioner and also to take appropriate steps with regard to house trespass against respondents no. 3 and 4. Learned State counsel also submits that petitioner himself is an accountant in the police department and was posted at Batala at the time of filing the petition. It is further submitted that no such representation has been made to respondent no. 2 by the petitioner.
In view of the above, the instant petition is disposed of with liberty to the petitioner to move comprehensive representation to respondent no. 2 and if the same is made within two weeks of receipt of certified copy of this order respondent no. 2 would look into the same and if required, take appropriate action in accordance with law.
