Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.164 dated 03.11.2018 under Sections 420, 379, 409, 465, 467, 471 and 120-B IPC, registered at Police Station Zira, District Ferozepur.
Notice of motion.
Ms.Monika Jalota, DAG, Punjab, has put in appearance on behalf of the respondent-State and contested the petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. As per the allegations, present petitioner, who was employed as Peon in a Bank, has stolen cheque book of the complainant and then got transferred `4,25,000/- from the account of the complainant by opening an VINEET GULATI 2019.03.08 16:15 I attest to the accuracy and authenticity of this document Chandigarh account in another bank in conspiracy with other accused. As per the FIR,
CRM No.M-9528 of 2019 -2the allegations are also that he has also got withdrawn the money through ATM and CCTV footage is there regarding the same. The petitioner has been in custody since 03.11.2018. He is not required for custodial interrogation as he is in judicial custody. The offences are triable by Judicial Magistrate. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the disposal of the case.
Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal/surety bonds in the sum of `50,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
