The anticipatory bail application of petitioner was dismissed vide detailed order dated 27.07.2017.
Learned counsel for the petitioner submits that similarly placed co-accused Anil Kumar has been allowed anticipatory bail by this Court and seeks grant of bail to the petitioner on parity. Learned State counsel submits that second bail application of petitioner is not maintainable. He further argues that co-accused Anil Kumar had resigned after four months from the company, as such, petitioner's case is not on parity.
As earlier bail application of petitioner was decided on merits, the question which arises for consideration is as to whether there exists any reason that the anticipatory bail in the second bail application can be allowed. FIR in this case was registered on receipt of information that petitioner and others are running an illegitimate firm, which is collecting `1,000/- per month from the public under the name and style of SRD Prize Distribution Club by playing fraud with the people and have collected huge amount but did not distribute the prizes to them or returned their money. The police has received applications of numerous persons, who have deposited their money with SRD Prize Distribution Club. The agents who got enrolled several persons have also been associated in the inquiry. It is submitted that so far as the police has traced the fraud to the tune of `40 crores and this figure is going up. Keeping in view the gravity of offence, I do not find any reason to allow this application. Same has no merits. Dismissed.
