(Oral) This petition has been filed under Section 482 Cr.P.C. for quashing of order dated 29.04.2016 passed by the Judicial Magistrate Ist Class, Ludhiana, whereby the petitioner has been declared proclaimed person in case FIR No.91 dated 16.10.2012 registered under Sections 406 and 498-A of Indian Penal Code at Police Station Women Cell, Ludhiana.

Learned counsel for the petitioner submits that the petitioner went to join the investigation but a wrong statement was made that the petitioner has not come to join the investigation. Ultimately, bail application filed by the petitioner was dismissed and thereafter, the petitioner and other co-accused filed Criminal Misc. No. NEETU RANI 2016.05.13 10:32 I attest to the accuracy and authenticity of this document Chandigarh

Criminal Misc. No. M-16267 of 2016 M-3861 of 2015 before this Court, which was also dismissed. Learned counsel for the petitioner also submits that without following the provisions of Cr.P.C., the petitioner has been declared proclaimed person as she was never served at the given address. The petitioner is ready to surrender before the trial Court. In view of the submissions made by learned counsel for the petitioner, the present petition is disposed of with a direction to the petitioner to surrender before the trial Court and in case, she surrenders before the trial Court within a period of one week from the date of receipt of certified copy of this order and moves an application for regular bail, the trial Court is directed to consider the same and pass necessary order in accordance with law within a period of one week thereafter.

Disposed of accordingly.
