NAMIT KUMAR, J. (ORAL) On the last date of hearing, following order was passed:- "Learned counsel appearing on behalf of the appellants states that the earlier counsel Mr. O.P. Hoshiarpuri, Advocate has since expired and thereafter despite several efforts they have been unable to contact the appellants and hence plead no instructions in the matter.

In view of the above, let notice of the appeal be issued to the appellants., returnable on 04.07.2023."

As per office report, appellant No.1 has expired and appellant Nos.2 to 4 are residing with in-laws.

Learned counsel for the appellants pleads no instructions. In the present appeal, cross-objections were also filed on behalf of respondent No.1. In terms of order dated 25.01.2023, notice of the appeal was also issued to respondent No.1.

As per office report, service of respondent No.1. is complete. However, none has put in appearance on his behalf.

In view of the above, the instant appeal as well as cross-objections are dismissed for non-prosecution.
