HARINDER SINGH SIDHU, J This is petition for grant of anticipatory bail to the petitioner in case appeal No.206 of 2016 pending in the court of learned Additional Sessions Judge-cum-Special Judge, Fatehgarh Sahib. The petitioner was convicted in a case FIR No.215 dated 30.11.2013 under Sections 406,420,120-B IPC, P.S Sirhind and sentenced to undergo RI for one year and to pay a fine of Rs.2000/- against which he preferred an appeal, which is pending before the court of learned Additional Sessions Judge, Fatehgarh Sahib for 14.3.2019. As the petitioner did not appear before the learned Appellate Court on the previous date, his bail bonds were cancelled and he was ordered to be summoned through nonbailable warrants.

Learned counsel for the petitioner states that his nonappearance was not intentional. In fact, the petitioner was indisposed and he had to go to the Civil Hospital, Fatehgarh Sahib for treatment and that the Doctor advised him rest. He could not inform the counsel in time as he MANOJ KUMAR 2019.03.

CRM-M-9473 of 2019 #2# was in hospital.

In these circumstances, this petition is allowed subject to payment of Rs.5000/- as costs to be deposited with the High Court legal Services Authority. The petitioner may appear before the learned Court on or before the date fixed i.e 14.03.2019. On his doing so, he shall be released on interim bail by the Court subject to his furnishing bail bonds and surety bonds to its satisfaction.
