**** RAJ MOHAN SINGH, J.(Oral) Petitioner has preferred this writ petition for the issuance of an appropriate writ in the nature of mandamus, directing the respondent No.2 to decide the representation of the petitioner, which was filed on 20.12.2018 (Annexure P-1). Perusal of the Annexure P-1 would indicate that the aforesaid representation is in the shape of mercy petition for releasing the service benefits as admissible to the petitioner as per entitlement of her late husband under the Government instructions.

Reply has not been filed.

Learned State counsel submits that the mercy petition filed by the petitioner has not been decided but her KUMARI SAPNA 2023.02.13 14:24 I attest to the accuracy and integrity of this document order/judgment

CWP-5892-2019  revision petition filed by the husband of the petitioner was dismissed on 22.12.2002.

In view of the nature of controversy, I deem it appropriate to dispose of the present petition, however, with a direction to the respondent No.2 to take final call on the pending mercy petition without being influenced by any statement of fact recorded hereinabove. If the claim of the petitioner is found to be maintainable on legal parameters then the same be considered in accordance with law.

Needful be done within three months from the date of receipt of certified copy of this order.
