None has been appearing on behalf of the contesting respondent Nos.1 to 4 despite service.

Learned counsel for the appellant-Insurance Company would contend that the challenge in the present appeal is to the limited extent that the Motor Accident Claims Tribunal, Karnal vide award dated 03.01.2019 has awarded the interest @ 12% per annum. The learned counsel would further contend that interest rate @ 12% per annum is on the higher side and that the rate of interest ought to have been 7.5% per annum. 3.

The coordinate Bench of this Court while issuing notice of motion had stayed the payment of interest beyond rate of 7.5%. The interest rate @ 12% awarded by the Tribunal is on the higher side and the same is Yogesh Sharma 2024.02.05 15:10 I attest to the accuracy and integrity of this order/judgment.

High Court Chandigarh

2024:PHHC:014803 FAO-1899-2019 (O&M) -2- hereby reduced to 7.5% per annum. Accordingly, the award passed by the Tribunal is modified to the extent above.
