(ORAL) Prayer in this 2nd petition is for grant of regular bail in FIR No.27 dated 24.01.2021 under Section 379-A IPC, registered at Police Station Civil Lines, Rohtak; earlier one was dismissed as withdrawn on 15.02.2022. Learned counsel for the petitioner submits that as per allegations in the FIR, registered at the instance of Sonia, while she was coming from park, three boys sitting on a scooter came and snatched his mobile having two SIM cards. It is further submitted that two co-accused of the petitioner, namely Pankaj @ D and Sahil have already been granted the concession of regular bail by the Additional Sessions Judge, Rohtak. CRM-M-11690-2022 -2investigation, when the petitioner was arrested, only Rs.100/- were recovered from him; he is in custody for the last 11 months and 10 days and it will take some in conclusion of the trial.

Learned State counsel has filed the custody certificate in the Court today and has not disputed the factual position. After hearing learned counsel for the parties, without commenting anything on merits of the case and considering aforesaid facts and circumstances of the case, this petition is allowed and the petitioner is directed to be released on regular bail subject to furnishing his bail/surety bonds to the satisfaction of the trial Court/Illaqa Magistrate/Duty Magistrate, concerned. Petition is disposed of.
