2( ,3 The petitioner has filed the present petition under Section 439 of Cr.P.C. with a prayer to grant him the concession of interim bail keeping in view his critical illness in a case arising out of case FIR No. 0048 dated 21.03.2023, under Sections 212, 216 IPC, 1860 and Sections 25, 27 of Arms Act, 1959 later on added Sections 109, 120-B of IPC, 1860 vide DDR No.27 dated 03.04.2023, Police Station Shahkot, District Jalandhar Rural, Punjab. 2.
Learned counsel for the petitioner contends that earlier also, the petitioner had filed a petition for grant of concession of interim bail and vide order dated 07.12.2023, he was granted interim bail for a period of three months on medical grounds. After the expiry of period of three months, he again filed the present petition and while issuing notice of motion, a Coordinate Bench of this Court had noticed the following contentions:- "Learned counsel for the applicant/petitioner contends that the condition of the petitioner is critical and he is
suffering from bed sores and other serious ailments; hence, he would require some specialized treatment which would not be possible inside the jail. He has submitted that the petitioner who is stated to be critically ill is also present in the Court today. Learned counsel for the applicant/petitioner submits that the petitioner who is present in the Court today, would not be averse for getting himself medically evaluated from any Government doctor today itself.
In the circumstances, the petitioner is directed to present himself before the Medical Superintendent of Government Multi Specialty Hospital, Sector 16, Chandigarh today itself. Heard.
It is very strange that a person who is critically ill, has managed to travel all the way to this Court, however, for surrendering back in the jail, he may not be in a position to do so. Be that as it may, notice of motion.
On asking of the Court, Mr. Amit Rana, Sr. DAG, Punjab accepts notice of the application.
The Medical Superintendent of Government Multi Specialty Hospital, Sector 16, Chandigarh is requested to get the medical evaluation done of the petitioner from the concerned medical specialist(s) and submit his report in a sealed cover before the next date of hearing. The doctors shall also give a categoric opinion as to whether the medical condition of the petitioner can be managed within the prison by the Jail doctor."

Since then, the interim bail granted to the petitioner has been extended from time to time. Learned counsel for the petitioner submits that even now, he is under constant medical supervision and is being treated at PGIMER, Chandigarh. Consequently, the interim bail may be extended for a
further period of three months, so that he may get himself medically examined from Multi-Speciality Hospital.

On the other hand, a status report has been filed by way of short affidavit of Deputy Superintendent of Police, Sub-Division Shahkot, District Jalandhar Rural and the same was earlier taken on record. 5.
Learned State counsel has referred to paragraphs No. 4 & 5 of the said report and the same have been reproduced below: - "4. That on 21.08.2025, the petitioner was medically examined at Postgraduate Institute of Medical Education and Research, Chandigarh wherein it was noticed by the doctor that the patient provisionally diagnosed for Spinal Cord injury Bilateral Neoplasia and the patient has Grade III bed sores. He was advised to regular follow up in the PGIMER on OPD basis. A true copy of the medical card issued by the pgimer is hereby placed on record as Annexure R1/2.

That the petitioner was again checked up by the doctor of Postgraduate Institute of Medical Education and Research, Chandigarh (PGI, Chandigarh) on 16.01.2026, wherein it was noticed by the doctor that Lesions over sores have healed and persistent sore over the buttock. He was advised to regular follow up in the PGIMER on OPD basis" A true copy of the medical card issued by the PGIMER is hereby placed on record as Annexure R1/3."

Learned State counsel submits that the petitioner is critically ill and is constantly under medical treatment and also needs some help for his daily activities.

I have heard learned counsel for the parties and perused the complete record in the present case.

Keeping in view the medical condition of the petitioner, the interim bail granted to the petitioner is extended for a further period of three months from today subject to his furnishing bail/surety bonds to the satisfaction of trial Court/Duty Magistrate concerned.

The petitioner shall surrender before the jail authorities concerned at 5:00 p.m. on 25.05.2026. However, it is made clear that the petitioner shall appear before the trial Court on each and every date of hearing and shall not apply for adjournments without any justification. Even if it is found that the petitioner is misusing the concession of bail granted to him in any manner, the State of Punjab would be at liberty to move appropriate application before this Court for cancellation of his bail.
