Petitioner seeks interim bail on account of death of his father in case bearing FIR No.6 dated 22.02.2018 under Sections 21, 23, 29 of the NDPS Act at Police Station State Special Operations Cell, Fazilka, District Fazilka. Notice of motion was issued on 16.03.2022 on the premise that father of the petitioner has expired on 11.03.2022 and 21.03.2022 is the date fixed for his Bhog Ceremony. The factum of death of father the petitioner and date of Bhog Ceremony were ordered to be verified by the State.  17.03.2022, the case was taken up and owing to the different statements of both the sides regarding date of Bhog Ceremony, the case was adjourned for today at the instance of learned counsel for the petitioner.

Today, none has appeared on behalf of the petitioner. Sub Inspector Davinder Kumar, Police Station SSOC, Fazilka has joined the proceedings through video conferencing along with Ms. Ambika Bedi, AAG, Punjab. Sub Inspector Davinder Kumar reiterates the fact that Bhog Ceremony has already been conducted on 13.03.2022 and there is no such Bhog Ceremony fixed for 21.03.2022. Learned State counsel submits that the police has recorded the statement of Sarpanch to this effect. Learned State counsel also submitted the statement of Sarpanch recorded by the police. In view of statement made by SI, Davinder Kumar and the factum of Bhog Ceremony not fixed for 21.03.2022, rather the same has already been done on 13.03.2022, I find no justification to interfere in this petition.

Dismissed.
