The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of order dated 14.05.1998 (Annexure P-7) whereby his selection as a Constable in Punjab Armed Police has been rejected.

The petitioner joined Punjab Police as SPO on 06.02.1995. His appointment was on compassionate ground as his father had died in a road accident on 06.11.1994 who was working as SPO with Punjab Police. He was issued appointment letter for the post of Constable. The petitioner was not allowed to join on the ground that no relaxation is available to wards of SPO, thus, he was extended relaxation under wrong impression. Mr. R.S.Bajaj, Advocate submits that petitioner does not lay his claim on the post of Constable, however, he may be considered for the post of SPO because he was relieved only to join as a Constable. 4.

Mr. Aman Dhir, DAG, Punjab submits that SPO is not a regular post and no appointment on compassionate ground can be made to the post of SPO.

Considering the facts that petitioner joined as SPO in 1995; he was relieved on 18.12.1996 so that he may join as a Constable; he was recruited as a Constable on 03.12.1996 though he was not entitled to the post of Constable on compassionate ground; he was not relieved from the post of SPO on the ground that he is ineligible, he deserves to be considered for the post of SPO.

The petition stands disposed of with a direction to respondents to consider the petitioner for the post of SPO, in accordance with law, if post is available and respondents at present are making appointment of SPO. The needful shall be done within three months from today. 7.
