On the instructions of ASI Darshan Singh, it has been informed that the petitioner has joined the investigation. In view of the said circumstance, this court is of the considered opinion that being a visitor u/s 468(3) of the Punjab Jail Manual, the petitioner appears to have been permitted an interview with Balwant Singh Rajowana. So far as the allegation that the entry was arranged without any recording in the visitor's register, the petitioner prima facie is not liable for any violation. It does not appear to be a case of custodial interrogation, especially when the jail officials have been granted the concession of prearrest bail by this court.

Accordingly, the petition is allowed and it is ordered that in case of arrest of the petitioners, he will be released on bail to the satisfaction of the arresting officer subject to the condition that he will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation. This order will remain operative till the presentation of challan.

Cr. Misc. M 16341 of 2016 the petitioner on appearance before the court concerned, will be entitled to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the said court.
