The petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.07 dated 7.1.2016 registered for the offences under Sections 365, 380, 302, 201, 483, 427, 411, 148 and 34 IPC at Police Station Amargarh, District Sangrur. Notice of motion to Advocate General, Punjab. Mr. V.P.S. Sidhu, learned Assistant Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner as well as learned Assistant Advocate General, Punjab appearing for the respondentState and have gone through the record. Harpal Singh Parmar 2017.05.23 16:24 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-15425 of 2017 [2] Certified copy of the charge-sheet has also been placed on the record. The allegations of kidnapping and murder are against the other coaccused. Against the present petitioner the charges have been framed only for the offence under Section 411 read with Section 34 IPC on the allegation that he dishonestly retained the stolen property i.e. one Karra gold and two and half American dollars which belonged to deceased Hardeep Singh. The petitioner has been in custody since 29.1.2016. Keeping in view the facts and circumstances of the present case and the fact that the allegation against the petitioner is only qua offence under Section 411 read with Section 34 IPC and in view of the fact that the trial of the case will take long time, no useful purpose will be served by keeping the petitioner in custody till the final disposal of the case.

Therefore, keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, this criminal miscellaneous petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal bond in the sum of `40,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
