The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent to issue her passport.

The Petitioner is a minor. She is residing with her mother. The marriage of parents of the petitioner was dissolved vide judgment and decree dated 27.05.2021 passed by Principal Judge, Family Court, Tarn Taran. In the decree of divorce, it has been specifically jotted down that custody of the child would remain with her mother and her father shall not claim custody in future. She applied for passport on 05.10.2022 alongwith requisite documents, however, passport has not been issued to her. 3.

Ms. Amrita Singh, Central Government Counsel for Union of India, who on advance notice is present in Court, accepts notice and waives service.

Ms. Amrita Singh submits that petitioner may be directed to appear before the passport authority alongwith requisite documents and the passport authority, thereafter, would pass an appropriate order within six weeks.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

In the wake of statement of both sides, the petition stands disposed of with a direction to petitioner to appear before the passport authority on 22.03.2024 alongwith requisite documents. On doing so, the passport authority would pass an appropriate order within six weeks from 22.03.2024.
