**** RITU BAHRI , J. (Oral) Through the instant civil writ petition, preferred under Articles 226/227 of the Constitution of India, petitioners have sought the issuance of a writ in the nature of Mandamus directing the respondents to restore increments granted @3% while fixing pay in the ACP scale on promotion. At the very outset learned counsel submits that the issue raised in the present petition is squarely covered by the judgment of this Court in a case of Narender Pal Singh Arya and another vs. State of Haryana and others, passed in CWP No. 3922-2011 and connected matters, decided on 03.10.2016. LPA filed against the said judgment also stands dismissed on 31.07.2018 (P-5), vide LPA No. 2460-2017.
In this regard, petitioners have served legal notice dated 01.12.2018 (P-6) but no action has been taken till date. Issue notice of motion.
On asking of the Court, Mr. Kiran Pal Singh, AAG, Haryana accepts notice on behalf of the State. Learned counsel for the petitioner shall supply copy of the petition to learned State counsel by today itself.
