This petition has been filed under Section 439(2) Cr.P.C. read with Section 482 Cr.P.C. for cancellation of bail granted to accusedrespondent No.2 by learned Judicial Magistrate Ist Class, Ambala, vide order dated 31.3.2017 (Annexure-P.3) in case FIR No.260 dated 2.9.2015 registered for the offences under Sections 406, 420, 467, 471, 419 and 201 IPC at Police Station Mahesh Nagar, Ambala Cantt. and for quashing of order dated 31.3.2017 (Annexure-P.3) granting bail to the respondent No.2. I have heard learned counsel for the petitioner and have gone through the record.

I have perused the order passed by the learned Judicial Magistrate Ist Class, Ambala. As per the order, the accused was in custody since 18.1.2017 and as the accused was in judicial custody, therefore, the Court below has rightly observed that nothing is to be recovered from the accused at that time. Cr. Misc. No.M-15474 of 2017 as to whether the accused/respondent No.2 is misusing the concession of regular bail or tampering with the evidence etc. No ground is made out for cancellation of regular bail granted by the learned Judicial Magistrate Ist Class, Ambala.

Therefore, finding no merit in this petition, the same is dismissed.
