Jaswant Singh,J(Oral) Prayer is for grant of anticipatory bail in Criminal Appeal No.22 dated 15.10.2013 titled Sandhuri Lal Mittal v Amrinder Singh in complaint no.2 dated 8.1.2010 pending in the Court of Mrs.Archana Puri, learned Sessions Judge,Mansa under Section 138 of the Negotiable Instruments Act(for short the Act). There is already and order passed by learned CJM,Mansa in proceedings under Section 138 of the Act for recovery of Rs.21 lacs against which the aforesaid appeal is stated to be pending. Due to non-appearance of the appellant/petitioner on 23.11.2015 his bail bonds were cancelled.
It was contended that due to unavoidable circumstances the petitioner/appellant could not appear.

CRM-M 16396/2016 Vide order dated 12.5.2016 notice of motion was issued and in the event of petitioner depositing a sum of Rs.1 lac, subject to decision of the appeal, and surrendering before the appellate court within 10 days from today, petitioner be released on interim bail to the satisfaction of the appellate court.
At the time of hearing today,learned counsel for the petitioner submits that in compliance of the order dated 12.5.2016 petitioner has deposited a sum of Rs. 1 lac on 18.5.2016 and was granted interim bail.
Learned counsel for the complainant submits that petitioner who is appellant before the Court below, since last many dates, through his counsel is avoiding to argue the matter. Therefore,prays for binding him down.
In view of the aforesaid circumstances, interim bail granted by the court below, pursuant to the order dated 12.5.2016 passed by this Court, is made absolute.
