Mr. Gopal Sharma, Advocate for the petitioner. RAJAN GUPTA J. (ORAL) Entire petition involves disputed questions of fact which cannot be decided in writ jurisdiction. Petitioner intends to refer to the revenue record to show that land of the petitioner is gair mumkin. This would essentially require evidence to be led by the aggrieved party. This apart, petitioner has also sought a writ of mandamus to grant compensation on account of illegal damages. In our considered view, writ of mandamus cannot be issued for the purpose of granting damages. Petition is, thus, misconceived and is hereby dismissed at this stage. Learned counsel for the petitioner submits that he may be granted liberty to avail alternative remedy. Liberty is granted to avail alternate remedy as per law.
