Naresh Kumar Sanghi, J.(Oral) CM-2772-C-2015 The present application under Order 22 Rule 3 read with Section 151, CPC, has been filed for bringing on record the legal heirs and representatives of sole appellant-Smt.Phoolo, who is alleged to have died during pendency of the present appeal. Notice of the application.

-2Mr.J.S.Dahiya, Advocate, who is present in Court, accepts notice on behalf of contesting respondent Nos.1, 6, 8 and

10. He has no objection if the present application is allowed and the legal representatives of Smt.Phoolo (since deceased) are brought on record.

Consequently, the present application is allowed. Kaptan Singh, Binder, Ranbir, Pardeep and Surjeet, the legal representatives of Smt.Phoolo (since deceased), are permitted to be arrayed as legal representatives of appellant Smt.Phoolo (since deceased). Amended memo of parties enclosed with the civil miscellaneous application is taken on record. CM disposed of.

CM-3047-C-2015 The present application has been filed under Order 23 Rule 1 read with Section 151, CPC, for permission to withdraw RSA-4682-2002.

Mr.J.S.Dahiya, Advocate, who is present in Court, accepts notice on behalf of contesting respondent Nos.1, 6, 8 and 10.

-3Learned counsel for the parties are ad idem that during pendency of the present appeal, the parties have resolved their dispute and effected a compromise and, as such, the pendency of the appeal shall be sheer abuse of process of law.

In view of the above, present application is allowed. The appellants are permitted to withdraw the present appeal. CM disposed of.

RSA-4682-2002 In view of the order of even date passed in CM-3047C-2015, RSA-4682-2002 is taken on board today itself and the same is dismissed as withdrawn.
