The prayer in the present petition under Section 528 BNSS, 2023 is for the issuance of directions to respondents No.2 and 3 to conduct a proper investigation in FIR No.292 dated 11.10.2024 under Sections 115, 3(5), 351(3) and 126 BNS, 2023 registered at Police Station Beri, Jhajjar.

The learned counsel for the petitioner contends that the son of the petitioner was taken away by respondents No.4 and 5 and he died on account of injuries suffered by him. As the accused persons are from influential families, the investigation has not been conducted in a fair manner. In fact, respondents No.4 to 8 are all involved in the unnatural death of the son of the petitioner and therefore, the investigation be handed over to some senior officers or to the CBI. 3.

The learned State counsel has filed a reply dated 08.05.2026, which is taken on record. While referring to the said reply, he contends

-2that respondents No.4 and 5 were interrogated and subjected to a polygraph test on 02.01.2025, wherein it was found that their answers were truthful and no evidence came forward against them. Later, an SIT was constituted under the Chairmanship of Assistant Commissioner of Police, Crime, Bahadurgarh. Medical opinion regarding the injuries on the person of the deceased was obtained and the concerned doctor opined that the deceased could have passed away on account of falling on a hard surface. On 02.08.2025, respondents No.4 and 5 were subjected to a narco test once again, wherein it has been found that their answers were not discrepant. It was in this scenario that the respondents No.4 and 5 were declared innocent. He further contends that statement of one Raghubir @ Pappu, driver of the auto, who has also been subjected to a polygraph test, has been recorded as per which the deceased was found in an injured condition on the side of the road and it was he, who first took him to CHC, Dighal and thereafter to the PGIMER, Rohtak. 4.

I have heard learned counsels for the parties. 5.

A perusal of the affidavit would reveal that the investigation has been conducted in a fair, impartial and a scientific manner. Respondent No.4/Punit and respondent No.5/Bhavishya have been subjected first to a polygraph test and thereafter to a narco test. One Raghubir @ Pappy, driver of the auto, who took the deceased to the hospital has also been subjected to a polygraph test. It has been found that all the accused have given truthful answers, and therefore, no evidence has come against them.

Apparently, the investigation has been conducted once by the local police and thereafter by an SIT. The doctor has opined that the

-3death would have been caused by a fall on a hard surface highlighted in the photographs.

In view of the above, I find no reason to transfer the investigation of the captioned FIR to the CBI as the investigation has been conducted in a fair manner and therefore, the present petition stands dismissed.

All the pending miscellaneous applications, if any, stand disposed of.
