(Oral) This is a petition which has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.51 dated 22.05.2014 registered under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station Fattu Dhinga, District Kapurthala.
Learned counsel argued that the petitioner has been in custody for almost two years.
Learned Deputy Advocate General on instruction from HC Surjit Singh states that this is a case of recovery of commercial quantity and only one witness remains to be examined who is an official witness and prays that some time cap should be put on trial and till such time bail should not be granted to the petitioner.

CRM-M-16413-2016 In the circumstances of the case I have come to the conclusion that this is a fair suggestion. Resultantly this petition is dismissed and the trial Court is directed to release the petitioner on bail to its satisfaction on 17.10.2016 (subject to the accused not obstructing the same) in case the prosecution does not conclude its evidence.
