Daya Chaudhary, J. (Oral) This petition has been filed under Section 482 Cr.P.C. for issuance of direction to respondents No.1 to 3 to take appropriate action upon the complaint made by the petitioner on 09.02.2016 against respondents No.4 and 5.
Learned counsel for the petitioner submits that the husband of petitioner, namely, Lachman Singh (respondent No.4) along with one Simarpreet Kaur (respondent No.5) has approached this Court by way of filing Criminal Misc. No. M-3061 of 2016 for protection of their lives and liberty mentioning therein that both of them are major and are apprehending threat at the instance of private respondents. Said petition was disposed of on 28.01.2016 with a direction to Superintendent of Police, Sirsa to take action on the representation moved by the petitioners therein. Criminal Misc. No. M-16429 of 2016 submits that a false statement was made.
Heard arguments of learned counsel for the petitioner and have also perused the documents available on the file. Without considering the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.2 to consider the representation dated 09.02.2016 (Annexure P-4) moved by the petitioner and take necessary action in accordance with law.
It is also made clear that the averments made in Criminal Misc. No. M-3061 of 2016 by the husband of the petitioner be verified and the direction issued by this Court on 28.01.2016 be complied with after considering the averments made by the petitioner in her representation (Annexure P-4) attached with this petition. In case, respondent No.2 comes to a conclusion that the averments made in Criminal Misc. No. M-3061 of 2016 are contrary to the facts, the necessary action be taken against respondents No.4 and 5. It is also made clear that both the parties be called and all documents attached with this petition as well as with Criminal Misc. No. M-3061 of 2016 be verified after conducting inquiry into the matter.
The necessary exercise be done within a period of four weeks from the date of receipt of certified copy of this order. Disposed of accordingly.
