The instant petition has been filed on behalf of the petitioner seeking grant of anticipatory bail in respect of aforementioned FIR. 2.
At the time of issuance of notice of motion, the following order was passed on 13.3.2024:
"The petitioner seeks grant of anticipatory bail in respect of a case registered vide FIR No.11, dated 24.1.2024 at Police Station Division No.1, District Jalandhar, under Section 25 of Arms Act. The FIR was lodged on the basis of secret information to the effect that one Jaspreet Singh @ Jassa, who was involved in several cases, was possessing a country made pistol and is proceedings on foot towards Verka Milk Plant Service Road via Kartarpur Service Road. Pursuant to receipt of said information, barricading was set
( 2 ) up and one person, who was coming on foot was apprehended by the police, who disclosed his name as Jaspreet Singh @ Jassa. His search yielded recovery of one .30 bore pistol alongwith 2 cartridges.
It is further the case of prosecution that during the course of interrogation, Jaspreet Singh @ Jassa suffered a disclosure statement that he had procured the aforesaid pistol, cartridges and also some 'heroin' from Aliyas from Pakistan, which was delivered through drone. He further disclosed that the aforesaid pistol and 'heroin' had been picked up by Gurjant Singh, Bhagwant Singh @ Manga and who further handed over the same to him (Jaspreet Singh @ Jassa). Jaspreet Singh @ Jassa further disclosed that he had already sold off the 'heroin'.
Learned counsel for the petitioner submitted that the petitioner is nowhere named in the FIR and came to be nominated on the basis of a disclosure statement, which would hardly carry any evidentiary value particularly in the absence of any other connecting evidence. It has further been submitted that the petitioner has a clean record and is not involved in any other case. Notice of motion for 21.8.2024.
Meanwhile, in the event of arrest, the petitioner be released on interim bail subject to his furnishing personal bonds and surety bonds to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C."

Learned State counsel, upon instructions from the ASI Gurmel Singh, has informed that pursuant to interim directions, the petitioner has since joined investigation and he is not required for any custodial interrogation.

Having regard to the aforestated position, wherein the petitioner is stated to have joined investigation and is not required for any custodial interrogation, the instant petition is accepted and the interim directions issued by this Court vide order dated 13.3.2024 are hereby made absolute, subject to the condition that the petitioner shall join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438(2) Cr.P.C. 21.8.2024 ( Gurvinder Singh Gill ) Geeta Judge Whether speaking /reasoned Yes / No Whether Reportable Yes / No
