CRM-M No.15543 0f 2017 -2since put in appearance in the trial Court and has been released on interim bail. He prays that interim bail granted to him by this Court be made absolute.

This request is being opposed by learned counsel for the respondent-complainant, submitting that allegations in the complaint are quite serious and as per his instructions, the petitioner is involved in some other criminal cases also.

After hearing the rival contentions, I find that the accused had been summoned in a complaint case. His guilt shall be determined during the trial. The primary purpose was to secure his presence, therefore, it would be proper and appropriate to grant benefit of pre-arrest bail to the petitioner. Therefore, the interim bail granted to the petitioner vide order dated 4.5.2017 is made absolute, subject to fulfillment of conditions under Section 438 (2) Cr.P.C.

The petition stands allowed accordingly.
