The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking setting aside of order dated 30.06.1999 (Annexure P-3) and order dated 04.04.2000 (Annexure P-5) whereby respondent has withheld his three increments. He is further seeking direction to respondent not to effect further recovery. 2.

While issuing notice of motion, a Division Bench of this Court vide order dated 25.07.2002 stayed recovery. 3.

Learned State counsel submits that petitioner passed away on 06.08.2023.

Keeping in view limited prayer, efflux of time and the fact that petitioner has passed away, order dated 25.07.2002 is hereby made absolute.
