******* SURINDER GUPTA, J.(Oral) Learned counsel for the petitioner seeks permission to withdraw the petition and submits that petitioner is residing at Varanasi (Uttar Pardesh) and complaint is pending at Karnal. It is not possible for him to leave his business and to reach Karnal on each and every date of hearing.

Petition is allowed to be withdrawn with liberty to petitioner to take all the pleas raised in this petition at appropriate stage before the trial Court.

The petitioner may move an application before the trial Court seeking exemption from personal appearance, giving an undertaking that he will have no objection if the evidence is recorded in his absence and further that his counsel will appear on each and every date of hearing and shall be authorised to cross-examine the witness. He will also undertake to appear in the trial Court as and when his presence is specifically required by the Court.
