(ORAL) Through this revision challenge has been laid to order dated 20.02.2019 of the appellate court, whereby, appeal filed by the petitioner against order dated 05.06.2018 of trial court, vide which, he has been ordered to pay fine of Rs.2 lacs under Section 446 Cr.P.C., was dismissed affirming the order of trial court. Heard.
There is no justification to set aside the perfectly legal order/judgment of trial court imposing fine of `2.00 lakhs upon the petitioner and duly affirmed by the appellate court. However, since, counsel for the petitioner has prayed for treating the case of the petitioner with leniency/mercy on the ground that he is a poor person, impugned order is modified to the extent that penalty of `2.00 lakhs is reduced to `1.00 lakh.
