HARINDER SINGH SIDHU, J The petitioner has preferred this petition under Section 482 Cr.P.C for seeking directions to the respondents to decide his representation dated 02.03.2018 (P.1).
The allegations of the petitioner are that he has been defrauded by the persons named in the representation of an amount of Rs.22,50,000/- which were paid to them by the petitioner for purchase of one acre land at Kharar. Said representation (P.1) is addressed to the Sr. Superintendent of Police, Fatehgarh Sahib.
It is not the case of the petitioner that prior to moving this representation, he had submitted a representation to the local police, in terms of Section 154 Cr.P.C, which provides that if an officer in charge of a police station refuses any person aggrieved to record the information then he may send the substance of such information, in writing and by post, to the Superintendent of Police concerned, who, if satisfied that such information discloses the commission of a cognizable offence, shall either MANOJ KUMAR 2019.03.06 09:23 I attest to the accuracy and integrity of this document
CRM-M-10148 of 2019 #2# investigate the case himself or direct an investigation to be made by any police officer subordinate to him, in the manner provided by this Code, and such officer shall have all the powers of an officer in charge of the police station in relation to that offence.
In these circumstances, this petition is disposed of with liberty to the petitioner to move appropriate application before the officer in charge of the concerned police station in terms of Section 154 Cr.P.C. If such an application is made, it is expected that the same shall be looked into by the respondents, in accordance with law and appropriate action shall be taken if so warranted.
