(ORAL) Challenge in the present writ petition is to the order dated 01.08.2000 (Annexure P-4) whereby permission was granted by the Financial Commissioner and Secretary, Punjab Government, Department of Rural Development and Panchayats, for selling the Shamlat Land in the ownership of Gram Panchayat Ajitwal Block-Moga-I, District Moga, through Resolution No. 4 dated 06.12.1999 bearing Khewat No. 717, Khatauni No. 1208, Khasra No. 82/84, measuring 6 kanals 5 marlas, accepting the market value of Rs.15,000/- per marla assessed by the Collector Moga, in open auction according to Rule 12 of the Punjab Village Common Lands (Resolution) Rules, 1964. Learned counsel for the State on instructions from Mr. Rajwinder Singh, BDPO, Moga-I, has informed this Court that land RISHU KATARIA 2022.07.14 10:27 I attest to the accuracy and authenticity of this document

CWP-2079-2001 -2in dispute has not been sold and a Community Centre, has been constructed on this land.

Since, the land in dispute has now been utilized for constructing a Community Centre, no cause of action survives. The instant writ petition stands disposed of as having been rendered infructuous.
