The present petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short-'BNSS') for quashing of criminal complaint No.35 dated 09.10.2020 under Sections 295, 324,326,148,149, 506 of IPC pending before learned Sub Divisional Judicial Magistrate at Sardulgarh, Mansa and all the subsequent proceedings arising therefrom, on the basis of compromise dated 28.01.2025 (Annexure P-2). 2.

Learned State counsel states that no other FIR has been registered against the petitioners and they have no known criminal antecedents. Mr. Kanhiya Goyal Advocate appears and accepts notice on behalf of respondent No.2. He has filed his memo of appearance on behalf of respondent No.2 in the Court today and the same is taken on record. He confirms the factum of the compromise having been effected between the parties and states that respondent No. 2 has no objection to the quashing of the FIR in question.

In that view of the matter, even if this case is taken to its logical conclusion, it would only be an exercise in futility as the parties have already settled their differences. Therefore, no purpose would be served in wasting the time and resources of the State in pursuing this case to its pre-ordained end. It would, therefore, be better to give a quietus to the issue at this stage. 6.

Accordingly, the petition is allowed and criminal complaint No.35 dated 09.10.2020 Sections 295, 324,326,148,149, 506 of IPC pending before learned Sub Divisional Judicial Magistrate at Sardulgarh, Mansa and all the subsequent proceedings arising therefrom, on the basis of compromise dated 28.01.2025 (Annexure P-2) shall stand quashed qua the petitioners. 7.
