Learned counsel for the petitioner would contend that the petitioner has been in custody for over five years as an under-trial. 2.

A perusal of the paper-book reveals that the present petition has been mentioned as the first petition for grant of regular bail to the petitioner under Section 439 CrPC, however, as per office report and as per the earlier orders, this is the 5th petition for grant of regular bail to the petitioner. 3.

Faced with the same, learned counsel for the petitioner seeks permission to withdraw the present petition. Permitted to do so. 4.

Dismissed as withdrawn. Pending applications, if any, also stand disposed off.
