Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.240 dated 13.04.2017 under Sections 67 and 67(A) of the IT Act 2000, registered at Police Station Ratia, District Fatehabad.

Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that FIR in the present case has been registered on the basis of resolution passed by the Gram Panchayat under the Chairmanship of Satnam Singh Sarpanch. CRM No.M-15669 of 2017 -2present petitioner are that a message was uploaded on WhatsApp on 10.04.2017 at about 12.30 AM from BJP Mandal Group Nagpur on Mobile No.9068229000 of Hardeep Dahiya (petitioner) that some residents of Gram Panchayat Hukamawali would commit sexual intercourse with their sisters. It is also in the message that on 10.04.2017, some people of village Hukamawali told under the influence of liquor that they did not need to go outside because they do sex with their sisters in their house. I have also perused the police file. At this stage, keeping in view the nature and gravity of the offence, I do not find it a fit case where petitioner is entitled to benefit of anticipatory bail. Therefore, finding no merit in the present petition, the same is dismissed.
