RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner Jagroop Singh @ Jyoti in a case arising from FIR No.46 dated 26.03.2017 under Section 379-B IPC registered at Police Station Garshankar, District Hoshiarpur. Learned counsel for the petitioner contends that both the material witnesses have turned hostile and, therefore, no useful purpose would be served by detaining the petitioner in jail. This fact is not disputed by learned State counsel.
Considering over-all facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail, on his furnishing bail bonds and surety bonds, to the satisfaction of Trial Court/Duty Magistrate concerned.
