R.P. Nagrath, J. (Oral) Petitioner seeks bail under Section 439 Cr.P.C. in FIR No. 55 dated 30.03.2015 for offences under Sections 420 and 489-B of Indian Penal Code (IPC), registered at Police Station Navi Baradari, District Jalandhar.
I have heard learned counsel for the petitioner, the State counsel and counsel for the complainant. The petitioner is said to have given counterfeit currency to Sonia-complainant while handing over an amount of ` 10 lacs for execution of the sale deed.
As per prosecution story, an amount of ` 7.5 lacs was given before the Sub-Registrar and soon thereafter an amount of ` 2.5 lacs was given which is stated to be fake currency. Learned counsel for the petitioner submits that there is FIR No. 26 dated 27.02.2010 against husband of the complainant for offences under Sections 452, 323 etc. recorded at JITENDER KUMAR 2015.07.16 16:12 I attest to the accuracy and authenticity of this document Chandigarh

Learned State counsel submits that the challan has since been presented against the petitioner on 29.05.2015. The petitioner is in custody since 30.03.2015 and it will take some time in conclusion of the trial. In view of the above and without commenting on merits of the case, the instant petition is allowed and petitioner be admitted to bail on furnishing bail bonds to the satisfaction of the trial Court.
