Ajaib Khan v. State Of Punjab
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CRM-M-15654-2015 Date of Decision: 21.05.2015 Ajaib Khan ......... Petitioner
Versus
State of Punjab ............ Respondent ***** CORAM : Hon'ble Mr. Justice T.P.S. Mann
Present:
Mr. Aakash Singla, Advocate for the petitioner.
Mr. Vikram Bishnoi, Asstt. Advocate General, Punjab. Mr. Anil Chaudhary, Advocate for the complainant.
**** T.P.S. Mann, J. (oral) This is the second petition filed by the petitioner for the grant of regular bail, the first one having been dismissed as withdrawn on 2.4.2014.
The petitioner, along with his co-accused, is facing trial in FIR No. 14 dated 24.2.2012 under Sections 302, 307, 149 & 148 IPC registered at Police Station Sherpur, District Sangrur. Learned counsel for the petitioner has submitted that when the earlier petition filed by the petitioner for the grant of regular bail was disposed of by this Court the trial had reached the stage of examination of the accused under Section 313 Cr.P.C. It is submitted that the case is now ripe for arguments. However, some of the coaccused of the petitioner have moved for transfer of the case and for that reason the trial is held up.

CRM-M-15654-2015 -2After obtaining instructions from HC Kamaljit Singh, learned State counsel has informed the Court that the trial is now fixed for 1.6.2015.
Once the entire evidence is over and the trial is at the stage of final arguments, it would not be appropriate to grant the concession of bail to the petitioner.
The petition is, therefore, disposed of.
