This petition has been filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No.173 dated 10.4.2016 registered for the offences under Sections 15 and 27-A of Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as `the Act') at Police Station Sadar Fatehabad, District Fatehabad.
Notice of motion to Advocate General, Haryana. Mr. Vikramjit Singh, learned Additional Advocate General, Haryana has put in appearance on behalf of the respondent-State and contested this petition.
I have heard learned counsel for the petitioner as well as learned Additional Advocate General, Haryana appearing for the HARPAL SINGH PARMAR 2016.08.05 17:28 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-16627 of 2016 [2] respondent-State and have gone through the record. As per the prosecution version, 5 Kgs. poppy husk has been recovered from the co-accused, which falls in commercial quantity and the petitioner has been named on the basis of disclosure statement of the coaccused. The petitioner has been in judicial custody since 22.4.2016. The petitioner, who is in judicial custody, is no more required for any interrogation and investigation purposes. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the final disposal of the case.
Therefore, keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, this criminal miscellaneous petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal bond in the sum of `30,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
