RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner Sikander @ Goldi in a case arising from FIR No.79 dated 06.10.2016 under Sections 325, 323, 452, 506, 148 and 149 IPC (Section 302 IPC added lateron) registered at Police Station City 2, Abohar, Tehsil Abohar, District Fazilka. Learned counsel for the petitioner contends that initially FIR under Sections 325, 323, 452, 506 and 148 read with Section 149 IPC was registered on the basis of statement of deceased himself. As per the FIR, no injury has been attributed to the petitioner. However, subsequently, the complainant died and the offence under Section 302 IPC was added. The petitioner is in custody since 17.10.2016. Co-accused Ajay @ Deepak has been granted regular bail by this Court vide order dated 24.04.2017 passed in CRM-M-9708 of 2017.
In view of the totality of the facts and circumstances, however, Ravinder Singh 2017.08.24 17:01 I attest to the accuracy and authenticity of this document without commenting on the merits of the case, petition is allowed.
