**** RAVI SHANKER JHA, CHIEF JUSTICE ( Oral ) The petitioner Company has filed this petition on account of the fact that it is not able to collect Toll Fee from respondents No.6 and 7, who have been given the contract by Municipal Corporation, Gurugram, for disposal of garbage.

After arguing at length, learned counsel for the petitioner prays that a direction be issued to the Municipal Commissioner, Municipal Corporation, Gurugram, to consider and decide the representation of the petitioner.

CWP-6634-2021 -2Shri Bijender Sharma, Sanitation Officer, Municipal Corporation, Gurugram, submits that officials of the Municipal Corporation, Gurugram, shall look into the matter and take necessary steps to ensure that terms of the agreement between Municipal Corporation, Gurugram and respondents No.6 and 7 regarding payment of Toll Fee/obtaining Fast Tag etc. are complied with.

In view of the aforesaid statement of learned counsel for respondents No.2 and 3 - Municipal Corporation, Gurugram, the petition is disposed of with a direction to Municipal Corporation, Gurugram, to take a decision on the representation of the petitioner in terms of the statement made before this Court and to communicate the same to the petitioner as well as respondents No.6 and 7. It is made clear that this Court has not expressed any opinion on the merits of the case and, therefore, the authorities would be at liberty to examine the matter keeping all facts and facets into consideration.
