RAMENDRA JAIN, J. (ORAL) Through this petition under Section 439 Cr.P.C., petitionerAmit, has prayed for grant of regular bail in case FIR No. 220 dated 28.08.2018 registered under Section 307 read with Section 34 IPC and Section 25 of the Arms Act (Section 27 of the Arms Act was added later on) at Police Station Barauda, Tehsil Gohana, District Sonepat. According to the prosecution, on 27.08.2018, the petitioner along with his two accomplice came at the liquor vend of the complainant and after enquiring about one Vinod, fired upon them. As a result thereof, his associate-Sandeep received fire arm injury on his leg. Learned counsel inter alia contends that petitioner is in custody since 14.09.2018. Injured-Sandeep, has already been examined as PW-2. Therefore, there is no chance of creating any hindrance in prosecution evidence by the petitioner. CRM-M-9808-2019 -2long time. No useful purpose would be served by detaining him in jail. Nothing has to be recovered from him.

On the other hand, learned State counsel vehemently opposed the submissions of learned counsel for the petitioner. Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner-Amit, is ordered to be released on bail pending trial, on his furnishing adequate bail and surety bonds to the satisfaction of trial Court/Duty Magistrate, concerned.
