The landowner is in appeal seeking enhancement of compensation for the acquired land.
Briefly, the facts are that vide notification dated 13.1.1995, issued under Section 4 of the Land Acquisition Act, 1894 (for short, 'the Act'), Union Territory, Chandigarh sought to acquire land situated within the revenue estate of village Kajheri, Union Territory, Chandigarh, for construction of approach road from Junction 58 and 59. The same was followed by notification issued under Section 6 of the Act dated 9.3.1995. The Land Acquisition Collector (for short, "the Collector") vide his award dated 8.5.1995 assessed the market value of the acquired @ ` 3,57,300/- per acre for all kinds of land except nadi, nala, river bed. Dissatisfied with the award of the Collector, the landowner filed objections. On reference, the learned court below, vide award dated 22.8.2001 determined market value of the acquired land @ ` 7,45,360/- per acre.
It is this award which is impugned by the landowner before this court. Learned counsel for the landowner submitted that the claim made in the present appeal is squarely covered by judgment of this Court in RFA No. 2417 of 2001 Ravinder Singh vs Union Territory, Chandigarh, decided on 7.1.2010, whereby compensation for the acquired SHARMILA 2015.10.28 14:34 I attest to the accuracy and authenticity of this document.
