Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.69 dated 14.05.2015 under Sections 302, 34 and 120-B IPC (Section 472 IPC and Sections 25 and 27 of the Arms Act added later on), registered at Police Station Goraya, District Jalandhar Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that FIR in the present case has been registered on the statement of Jaswant Singh. CRM No.M-15749 of 2017 -2occurrence at about 6.30 p.m., Narinder Singh @ Ninder, had gone with neighbour Barjesh Kumar out of house for a walk. In the evening about 7.30 p.m., when the complainant was standing near his house, a white coloured vehicle came and stopped near him. Two young persons Rahul and his companion stepped out from the vehicle and they were carrying respective pistols in their hands and fired at complainant's brother Narinder Singh @ Ninder and injured him seriously.

As per prosecution version, present petitioner was also sitting in the car. The case is at preliminary stage. No witness has been examined so far. There is every apprehension of tampering with the evidence. Otherwise also, keeping in view the nature and gravity of the offence, I do not find it a fit case where petitioner is entitled to benefit of regular bail. Therefore, finding no merit in the present petition, the same is dismissed.
