-.- KARAMJIT SINGH , J. (Oral) Prayer is for grant of anticipatory bail in case having FIR No.121 dated 28.8.2021 registered under Sections 341, 323, 148, 149 IPC (Sections 308, 325 IPC added later on) at Police Station Bhavwala, District Fazilka.

Counsel for the petitioner submits that at the time of alleged incident the petitioner was less than 18 years of age and now he has attained the age of majority and the petitioner was not named in the FIR and no specific allegations has been levelled against the petitioner. ( 2 ) CRM-M-11929-2022 further submits that the petitioner has joined investigation with the police by virtue of previous order dated 22.3.2022 passed by this Court. State counsel on instructions from ASI Jasbir Singh has not refuted the aforesaid assertions made by counsel for the petitioner that at the time of the occurrence the petitioner was minor and now he has attained the age of majority and also admitted the fact that the petitioner was not named in the FIR. State counsel further submits that petitioner who has associated with the investigation is not required by police for further investigation or for custodial interrogation.

In view of the above, without commenting on the merits of the case, the present petition is hereby allowed and order dated 22.3.2022 is hereby made absolute. The petitioner should abide by the conditions envisaged under Section 438(2) Cr.P.C.
