The petitioner has been declared a proclaimed offender in a case of assault on complainant Sanjiv Jindal, being a member of an unlawful assembly. Challan has already been presented against his coaccused. pursuant to the interim order, the petitioner has joined the investigation.

Counsel for the complainant has intervened to oppose the petition for pre-arrest bail, relying upon a photograph from CCTV footage, indicating that the petitioner along with an article like base ball bat is seen arriving in the premises of the complainant.

On the instructions of ASI Janak Raj, it has been informed that the petitioner has joined the investigation and got recovered a sum of Rs. 50000/- snatched by him and a knife, which was used in the occurrence. It will certainly be a debatable issue whether the petitioner was armed with a baseball bat or a knife. Be that as it may. The petitioner has joined the investigation. Supplementary challan has already been presented against the petitioner and he is being tried along with other co-accused. Sending

Cr. Misc. M 16667 of 2016 him behind the bars, at this stage, does not appear to be of any use in the above circumstances.

The petition is allowed. The petitioner will remain on bail against the bail bonds already furnished before the trial court subject to the condition that he will not make any attempt to threaten the complainant or the prosecution witnesses and will not misuse his liberty. In case of any such activity of the petitioner, the complainant will be at liberty to approach this court for cancellation of bail.
