RAMENDRA JAIN, J. (ORAL) Case has been taken up for hearing through video conferencing. Through instant second petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner - Angrej Singh - in case arising from FIR No.332 dated 22.09.2017 registered under Sections 15 and 25 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Bhuna, District Fatehabad.

According to prosecution, on 22.09.2017, 200 kgs of poppy husk was recovered from the truck driven by petitioner. Learned counsel inter alia contends that petitioner was not aware about carrying of poppy husk in the truck by his co-accused. He is not involved in any other case under the NDPS Act. Petitioner is in custody since 22.09.2017. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioner in jail any more. -2CRM-M-9503 of 2020 Co-accused of the petitioner, namely, Amar Singh has been granted regular bail by this Court vide order dated 09.12.2019 passed in CRM-M-47114 of 2019. Thus, treating the case of the petitioner on the same parity, as that of his co-accused, he may also be granted concession of regular bail. On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, treating the case of the petitioner on the same parity as that of his aforesaid co-accused, petition is allowed. Petitioner - Angrej Singh - is ordered to be released on bail during pendency of trial, if not required in any other case, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
