This is a petition that has been filed seeking to challenge the order dated 20.12.2017 by which the Sessions Judge, Ferozepur had dismissed the revision petition, which had been filed seeking to challenge the order of maintenance as allowed by the Chief Judicial Magistrate, Ferozepur.

In brief, the facts are that the a petition under Section 125 Cr.P.C. had been filed seeking maintenance by the respondent-wife, which application was allowed and the petitioner herein had been directed to pay an amount of Rs.2500/- each to the wife and two minor children along with Rs.5500/- as litigation expenses. The Chief Judicial Magistrate while passing the order held that the evidence of the applicants stood unrebutted and un-challenged, as the petitioner-husband had failed to turn up for crossexamination. The said order was challenged before the Sessions Judge, Ferozepur by way of a revision petition, which was dismissed. Aggrieved against the aforementioned order, the instant petition has been filed. CRM-M No.16641 of 2018 -23.

It is worthwhile to note that by an order dated 09.07.2019, the petitioner had been directed to pay 50% of the total arrears of maintenance as on date within two months and the matter was then listed for compliance on 30.09.2019, on which date, it was noted that no one had put in appearance and today also, no one has put in appearance despite the case having been called twice. There is nothing available on record to show that there has been compliance of the order dated 09.07.2019. Consequently, this Court find no ground to interfere with the orders so passed. 4.

The instant petition stands dismissed.
