(ORAL) The instant Petition has been filed under Section 439 of the Code of Criminal Procedure seeking Regular Bail on behalf of the Petitioner in case FIR No.318, dated 29.12.2019, registered under Section 379 of the Indian Penal Code, 1860, at Police Station South, Sector 34, Chandigarh. 2.
Seen Custody Certificate sent up on behalf of the Petitioner, from which it transpires that he has remained in detention in the present case for 1 month and 11 days. In the meantime, after completion of investigation, Challan against him has already been submitted. 3.
Further detention of the Petitioner, in the circumstances, at a stage when he is already on an interim bail since 28th March, 2020 following the outbreak of Covid-19 Pandemic last year (expiring today by 5.00 PM), and even the trial itself is yet to commence, is not called for. As such, he is ordered to be released on bail subject to the satisfaction of the Ld. Trial Court/Duty Magistrate concerned.
