Rajan Gupta, J (Oral) This is a petition under Section 439 Cr.P.C. seeking regular bail in a case registered under Sections 307/323/34 IPC vide FIR No.89 dated 16.4.2015 at Police Station, Nakodar, District Jalandhar. Learned counsel for the petitioner submits that all injuries have been declared as simple in nature. Petitioner was not armed with any sharp edged weapon.He is stated to have caused injuries with bricks which were lying at the spot.

Learned State counsel has opposed the plea. According to her, since injuries have been caused on the head of the complainant. In view of same, offence under Section 307 IPC is made out. Heard.

Keeping in view the fact that petitioner is alleged to have caused injuries with bricks and the same having been declared simple in nature, I am of the considered view that no useful purpose would be served by detaining the petitioner in custody any longer. Thus, without expressing any opinion on the merits of the case, this petition is allowed and the petitioner is directed to be released on bail to the satisfication of Chief Judicial Magistrate/ Duty Magistrate, Jalandhar.
