(ORAL) Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner Jugraj Singh in a case arising from FIR No.225 dated 05.012.2015 registered under sections 307, 324, 325, 148 and 149 IPC and Section 25 of the Arms Act at Police Station Sadar Tarn Taran, District Tarn Taran.

According to the prosecution, on 03.12.2015, petitioner from his double barrel 12 bore gun fired at complainant Gurjit Singh and pellets of the same hit his cheek and thigh. Injury received through pellet by the complainant on his thigh has been declared dangerous to life. Learned counsel for the petitioner inter alia contends that petitioner is in custody since 02.01.2018. Complainant did not appear for his deposition on 16.07.2018 before the trial Court despite clear-cut direction to him in this respect vide order dated 09.07.2018. Now the case is fixed for 27.08.2018. Conclusion of trial may take a sufficient long time. -2CRM-M-16652 of 2018 On the other hand, learned State counsel has vehemently opposed the grant of regular bail to the petitioner.

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
